WEBSITE’S USE – TERMS AND CONDITIONS

“Le Club” is a tradename registered under FONCIERA LIFESTYLE LTD, a company duly registered in the Republic of Mauritius bearing business registration no. C20172608 with its office situated Domaine de Labourdonnais, Mapou (hereinafter referred to as “Fonciera”). Fonciera operates Le Club’s Website, located at www.leclub.mu (the “Website”).

These terms and conditions (the “Terms”) outline the rules and regulations for the use of the Website. Fonciera also operates an application software (“Le Club App”) which can be downloaded from the Website, and can therefore enforce the following Terms upon the use of the Le Club App.

By accessing this Website, you agree to be bound by these Terms. You should therefore read the Terms carefully before using the Website. Do not continue to use this Website if you do not agree to any of the following Terms.

This Website is not intended for minors under 18 and does not knowingly collect data relating to minors. If you are a minor, you should refrain from using this Website.

Your Account and Password
You may need to register for accounts with us on the Website in order to access certain services available on the Website (“Account”).

You can register for a Le Club account either via the Website or via the Le Club App. If you register an Account, you will be asked to provide certain information (such as your email address) and to create a password, as part of our security procedures. You must treat such password as confidential and you must not disclose it to any third party.

We have the right to disable any Accounts and/or passwords, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms.

If you know or suspect that anyone other than you know your Account login details, you must immediately notify us at info@leclub.mu.

You are responsible for any unauthorised use of your Account login details.

Acceptable Use
You agree not to:

(a) use the Website in any unlawful manner, for any unlawful purpose or in any manner inconsistent with these Terms;

Parts of this Website offer an opportunity for users to post and exchange opinions and information in certain areas (the “Comments”). Le Club does not filter, edit, publish or review Comments prior to their presence on the Website. Comments do not reflect the views and opinions of Le Club, its agents and/or affiliates. Comments reflect the views and opinions of the person who post their views and opinions.

To the extent permitted by applicable laws, Le Club shall not be liable for the Comments or for any liability, damages or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of the Comments on this website.

Le Club reserves the right to monitor all Comments and to remove any Comments which can be considered inappropriate, offensive or causes breach of these Terms and Conditions.

You warrant and represent that:

(a) You are entitled to post the Comments on our website and have the capacity and all necessary licenses and consents to do so;

(b) The Comments do not invade any intellectual property right, including without limitation copyright, patent or trademark of any third party;

(c) The Comments do not contain any defamatory, libellous, offensive, indecent or otherwise unlawful material which is an invasion of privacy

You hereby grant Le Club a non-exclusive license to use, reproduce, edit and authorize others to use, reproduce and edit any of your Comments in any and all forms, formats or media.

Le Showroom Privé

Le Showroom Privé section of Le Club showcases products and services provided by its collaborators (restaurants, hotels, spa, shops, activities providers and more). All the listed products and services provided at privileged rates are subject to terms and conditions aligned with the member’s terms and conditions. The prescribed privileges and benefits are solely eligible for Le Club Members (Privilege, Premium and Elite Package). Non-Member users shall never use the privileges, perks and benefits available to Members as bargaining or price benchmark to collaborators.

By using, navigating and browsing through the website you hereby agree and understand that the website only shows products and services from its collaborators and holds no responsibility to stock availability and/or any change in price for any products and services listed in the website.

It is the responsibility of the user to check the price, stock availability, quality of the product and other specifications at the collaborator shop or outlet.

The user hereby discharges all responsibilities and liabilities to Fonciera in terms of; defect products or services, change in price tags, product contents and details and stock level. Whilst Fonciera shall maintain to the best of its knowledge the most accurate and on time information and details as may be provided and approved by its collaborators.

Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Mauritius, and the Courts of Mauritius are the only competent jurisdictions for any dispute arising within the scope of the said Terms.
